The agreement can be signed electronically, but it must:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Identify the specific phone number<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Clearly state that the person agrees to receive marketing calls, robocalls or texts<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Explain that consent is not required to make a purchase<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Include the person\u2019s signature<\/span><\/li>\n<\/ul>\n<p><b>Keep proof of consent on file in case you ever need to show you\u2019re compliant.<\/b><\/p>\n<h3><span style=\"font-weight: 400;\">2. Update calling schedules.<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The new rules narrow the hours when you can make solicitation calls. You can\u2019t call on Sundays and must restrict calls on other days to 9 a.m.\u20137 p.m. based on the recipient&#8217;s local time, rather than your business&#8217;s time zone.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">3. Honor text opt-outs.<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Make it easy for subscribers to stop receiving marketing texts. Pennsylvania recognizes replies such as \u201cstop,\u201d \u201cquit,\u201d \u201cend,\u201d \u201crevoke,\u201d \u201copt out,\u201d \u201ccancel\u201d and \u201cunsubscribe\u201d as opt-out requests.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Businesses should:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Document how they handle these replies<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Maintain updated do-not-contact lists\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Train employees on the process<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Following the required procedures can help protect against liability.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">4. Review registration requirements.<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">There are some updates to registration exemptions and adds a new one for communications that aren&#8217;t considered telephone solicitations. Since communications made with qualifying written consent are excluded from that definition, some businesses may no longer need to register.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the old wording, a business could be required to register as a telemarketer even if it didn&#8217;t make a \u201ctelephone solicitation call.\u201d The updated law addresses this gap, so <\/span><b>review the new requirements to see whether your business still needs to register.<\/b><\/p>\n<h3><span style=\"font-weight: 400;\">5. Avoid deceptive practices.<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Businesses also need to review how they collect consent and identify themselves to callers. Pennsylvania prohibits deceptive practices used to get permission for marketing messages, as well as machine-generated messages used to mislead subscribers. This includes AI-generated scam calls and certain forms of caller ID spoofing.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Is There a New Bond Requirement?<\/span><\/h2>\n<p><b>No, Pennsylvania telemarketers still need a <\/b><a href=\"https:\/\/www.suretybonds.com\/states\/pennsylvania\/telemarketing-entity-bond\"><b>$50,000 Telemarketing Entity Bond<\/b><\/a><b> to register with the Attorney General. <\/b><span style=\"font-weight: 400;\">However, some businesses may qualify for an exemption under the updated law.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Next Steps<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Pennsylvania&#8217;s updated Telemarketer Registration Act took effect on October 19, 2026.
