Construction flagging contractors in Oregon will soon be required to become licensed and post a surety bond following the passing of Senate Bill 596. Signed into law on June 10, 2015, the bill takes effect on July 1, 2017.
Construction flaggers direct traffic around construction sites. Construction flagging contractors are those who employ flaggers. They must obtain a flagging contractor license before performing any work as a flagging contractor. Individuals who hold the following licenses are not required to obtain a flagging contractor license:
- residential general contractor
- commercial general contractor levels 1 or 2
- commercial speciality contractor levels 1 or 2
Applicants for a flagging contractor license should submit their licensing application in accordance with Oregon Revised Statutes 701.046. They must also obtain a $20,000 surety bond, ensuring that they will comply with all laws and regulations pertaining to their profession and will complete work as promised. The surety bond requirement is in accordance with ORS 701.068.
The law does not apply to those working for federal or local government or a business regulated by the Public Utility Commission.
